A three-judge bench comprising Justice Ranjan Gogoi, Justice Navin Sinha and Justice KM Joseph said the appeal would be heard along with a petition filed by Hemraj’s wife Khumkala Banjade.

Banjade, too, has filed a petition in the apex court challenging the Allahabad High Court verdict.

Rajesh and Nupur Talwar, both dentists, were acquitted on 12 October 2017 by the Allahabad High Court which said there was no evidence to suggest that they were guilty of killing their daughter and help on the intervening night of 15-16 May 2008 in their home in Noida.
A CBI court had in 2013 sentenced the couple to life imprisonment for the double murders. The Talwars spent four years in jail before their acquittal in the case.
According to reports, the CBI challenged the order of the Allahabad High Court in May this year.
Aarushi Talwar, 13, was found in her bedroom with her throat slit on 16 May. Police initially suspected Hemraj, 45, but found his body on the roof of the house a day later.
The then Mayawati government handed the case over to the CBI. While the agency accused the Talwars, the couple said they did not kill anyone and claimed they were made victims of a botched investigation.
